Last updated: September 14, 2026
All riders must be at least 18 years of age. You represent and warrant that you are at least 18 years of age. If you are not at least 18 years of age, this agreement is void and you may not rent from Ride Newport Beach LLC. A valid government-issued photo ID is required at the time of delivery. Ride Newport Beach LLC reserves the right to refuse service to any individual who cannot present a valid photo ID at the time of delivery, or who appears to be under the influence of alcohol, drugs, or any impairing substance.
The rented e-bike is a Class 2 electric bicycle capable of speeds up to 20 mph with pedal assist and up to 20 mph via throttle. You acknowledge that you have been informed of the bike's speed capabilities and agree to operate it within all applicable speed limits, bike lane requirements, and regulations under California Vehicle Code sections 312.5 and 21213.
Riding an electric bicycle involves inherent risks, including but not limited to falls, collisions, equipment failure, road hazards, and interactions with motor vehicles, pedestrians, and other cyclists. These risks can result in serious bodily injury or death. By renting from Ride Newport Beach LLC, you voluntarily assume all risks associated with the use of our e-bikes, whether or not described herein.
You represent that you are in good physical health, have no medical conditions that would impair your ability to safely operate an electric bicycle, and are not under the care of a physician who has advised against physical activity or cycling. If you have any pre-existing medical conditions (including but not limited to heart conditions, seizure disorders, or balance impairments), you assume all additional risk associated with operating the e-bike.
As a rider, you agree to:
The e-bike shall not be used for: racing, stunts, jumps, or trick riding; towing or pulling any person or object; riding on unpaved trails, sand, or off-road surfaces unless designated for bicycle use; any commercial or revenue-generating purpose; or any illegal activity. Violation of this section constitutes a breach of this agreement and may result in immediate termination of the rental without refund.
A helmet is provided with every rental and must be worn at all times while riding. Failure to wear the provided helmet is a violation of these terms and may void any liability protections afforded to you under this agreement.
You shall not modify, tamper with, or attempt to alter any component of the e-bike, including but not limited to the motor, battery, throttle, speed limiter, brakes, or electrical system. Any unauthorized modification will result in full financial responsibility for all resulting damage.
A refundable security deposit of $200 is collected at the time of delivery. The deposit will be refunded once the e-bike and all accessories are returned in good condition. You are financially responsible for any damage to, loss of, or theft of the rented e-bike and all included accessories (helmet, lock) during the rental period. The replacement value of each e-bike is up to $2,000. By providing your payment information, you authorize Ride Newport Beach LLC to charge your payment method on file for any damage, loss, theft, or unreturned equipment, including the full replacement value and any included accessories, without further notice.
Failure to return the e-bike and all accessories by the agreed-upon time, or failure to make the e-bike available for pickup, may be treated as theft and reported to local law enforcement. You will be responsible for the full replacement value of the e-bike and accessories, plus any costs incurred by Ride Newport Beach LLC in recovering the equipment.
You are solely responsible for any damage you cause to third-party property or persons while operating the rented e-bike. Ride Newport Beach LLC assumes no responsibility for any fines, citations, traffic violations, or claims arising from your operation of the e-bike.
Your rental begins at the scheduled delivery time and ends when the e-bike is returned to or picked up by Ride Newport Beach. Late returns may incur additional charges at a rate of $20 per additional hour.
Cancellations made more than 2 hours before your scheduled rental will receive a full refund. Cancellations within 2 hours of the rental may be subject to a cancellation fee. In the event of rain or unsafe weather conditions, we will reschedule your rental at no charge. Ride Newport Beach LLC shall not be liable for any failure to perform due to causes beyond its reasonable control, including but not limited to natural disasters, government orders, civil unrest, pandemic, or other force majeure events.
To the fullest extent permitted by law, Ride Newport Beach LLC, its owners, members, employees, and agents shall not be held liable for any injury, death, property damage, or other loss arising from the use of our e-bikes. This includes, without limitation, injuries caused by road conditions, weather, other vehicles, equipment malfunction, or rider error. In no event shall Ride Newport Beach LLC's total liability exceed the amount paid for the rental.
You agree to indemnify, defend, and hold harmless Ride Newport Beach LLC, its owners, members, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the rented e-bike, your breach of this agreement, or your violation of any law or regulation.
By renting from Ride Newport Beach LLC, you waive any and all claims against Ride Newport Beach LLC, its owners, members, employees, and agents for injury, death, or property damage that may occur during the rental period. This waiver applies regardless of whether such claims arise from negligence or any other cause.
You agree that your electronic signature on the digital waiver form has the same legal force and effect as a handwritten signature, in accordance with the California Uniform Electronic Transactions Act (Cal. Civ. Code § 1633.1 et seq.) and the federal ESIGN Act (15 U.S.C. § 7001 et seq.).
If any provision of these Terms & Waiver is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
These Terms & Waiver constitute the entire agreement between you and Ride Newport Beach LLC regarding the rental of e-bikes. No oral or written representations, promises, or agreements made outside of this document shall be binding on either party.
These terms shall be governed by and construed in accordance with the laws of the State of California. Any disputes arising under these terms shall be resolved in the courts of Orange County, California.
By completing a booking or signing the digital waiver, you acknowledge that you have read, understood, and agree to be bound by these Terms & Waiver. You confirm that you are entering into this agreement voluntarily and that you understand the risks involved in operating an electric bicycle.
